This is really sad. Something tells me that judge shouldn't be re-elected.

It's Fine

Spamhaus doesn't have to pay the $11 mil, because they're established in the U.K., which has different laws. However, it is major crap that had they been set up in America, they'd have had to pay the fine. This motivates me to move to Europe, even though I'm one of the most pro-American citizens I know.

It is just how the system works

Can you suggest a different responce in this case? Spamhaus could have come over and argued their case, but elected not to.

If they had been in the US, they would have sent lawyers to argue the case. But considering the fact that they can't actually be required to pay the fine levied, it makes very little sense for them to waste money on a case that lacks the legal standing to invoke sanctions.

This is the way that the courts were set up to work. Requiring anybody sued to show up even when paying the total amount is less expensive than giving up the days at work is not what I think of when I think of efficient trials.

Of course, I believe that they would have beaten the spammers in a trial, but risking setting precedence in favor of spammers is probably the most reckless thing they could have done.

the good news....

they didn't really win, and it has nothing to do with the justice system (sort of). Spamhaus didn't bother fighting, why waste money defending yourself in a court that has no countrol over you. So like the artical said it was just a default ruling, the judge didn't really have much of a choice.
